1. Acceptance of Terms

Please read these Terms of Service ("Terms") carefully before using TIERENA ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Definitions

"Service" refers to the voting-based ranking platform "TIERENA" provided by its operators.
"User" refers to any individual or entity that uses the Service.
"User Content" refers to all information, text, images, and other content that Users post, upload, or create on the Service.
"Arena" refers to a voting-based ranking unit created by Users.
"Voting" refers to the selection actions performed by Users on items within an Arena.

3. Service Overview

The Service is a voting-based ranking platform designed for entertainment and recreational purposes. Users can create Arenas on various themes, engage in fun voting with other Users, and generate community-based rankings.

Important: Rankings generated on the Service are for entertainment and recreational purposes only and are not intended for academic or professional evaluation. Voting results reflect personal preferences and enjoyment.

4. User Responsibilities

4.1 Responsibility for User Content

Users are solely responsible for all User Content they post. This includes, but is not limited to:

Accuracy, legality, and appropriateness of posted content
Responsibility for infringement of third-party intellectual property rights, portrait rights, and privacy rights
Consequences of posting illegal, harmful, insulting, or inappropriate content
Legal liability for unauthorized use of copyrighted material

4.2 Voting Integrity

Users agree to conduct honest and fair voting. The following actions are strictly prohibited:

Fraudulent voting using automated bots or scripts
Creating multiple accounts to manipulate voting results
Voting on behalf of other Users
Requesting or providing votes in exchange for monetary compensation
Abusing the voting system to harm the Service's integrity

We emphasize again: Voting on the Service is purely for entertainment and enjoyment purposes. Fraudulent manipulation of votes undermines community trust and diminishes the fun of the Service.

5. Prohibited Conduct

Users must not engage in the following actions:

Actions that violate laws, these Terms, or public order and morals
Actions that infringe on the rights of other Users or third parties
Creating content that promotes discrimination, slander, or incitement against specific individuals, races, ethnicities, religions, or sexual orientations
Posting discriminatory, offensive, or harmful content
Intentionally posting false or misleading information
Spam, harassment, or unauthorized commercial solicitation
Actions that compromise the Service's security
Actions that interfere with the Service's operation
Posting content harmful to minors

6. Intellectual Property Rights

All intellectual property rights in the Service, including copyrights and trademarks, belong to us or to the rights holders who have granted us licenses.

Intellectual property rights in User Content belong to the User. However, Users grant us a non-exclusive license to use, reproduce, modify, publish, and distribute User Content to the extent necessary for operating the Service.

7. Privacy and Data Protection

The handling of personal information is governed by our separate "Privacy Policy." By using the Service, Users are deemed to have agreed to the Privacy Policy as well.

8. Service Modifications and Suspension

We may, with as much prior notice to users as possible, modify, add to, delete, or temporarily suspend the Service for improvements or maintenance. However, in cases of emergency or unavoidable circumstances, we may do so without prior notice. Furthermore, we may permanently discontinue or terminate the Service with a notice period of at least two weeks. We shall not be liable for any damages arising from such changes or discontinuation, except in cases of our willful misconduct or gross negligence.

9. Account Suspension and Deletion

If we reasonably determine that a User has violated or is at risk of violating these Terms or applicable laws, or has engaged in conduct that significantly impairs the sound operation of the Service, we may, without prior notice, (1) suspend or delete the User's account, and/or (2) remove or hide any content posted by the User.

10. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an 'as is' and 'as available' basis. We do not make any express or implied warranties regarding the completeness, accuracy, usefulness, or security of the Service. Except in cases of our willful misconduct or gross negligence, we shall not be liable for any damages arising from the use of the Service. In particular, we are not responsible for the following:

We do not endorse, guarantee, or assume responsibility for the content, accuracy, legality, or safety of any content posted by users (including all text, images, and links such as affiliate links). We are not liable for any issues arising from such content.
The operator carefully selects third-party services (such as Supabase, Vercel, and Stripe) that are widely trusted in the industry and have a stable operational track record to serve as the foundation for this service. The operator continuously monitors the operational status and security information of these third-party services and strives to provide prompt information and response to minimize the impact on users in the event of failures or incidents. However, as a general rule, the operator is not liable for damages incurred by the user arising from these third-party services themselves, such as service interruptions, data loss, or security incidents.
We are not responsible for any transactions, communications, or disputes that may arise between you and other users or third parties in connection with your use of the Service. Such disputes must be resolved directly between the parties involved.
To maintain the integrity of the Service, the operator strives to develop features to detect and limit votes made by automated means or fraudulent methods ('Fraudulent Voting'). However, these features will be implemented gradually, and we do not currently guarantee the complete prevention or elimination of all Fraudulent Voting. The operator assumes no responsibility for the accuracy, reliability, or fairness of the voting results.
While the Service is available globally, it is primarily governed by the laws of Japan. We will make reasonable efforts to comply with additional legal requirements of other jurisdictions, including the EU/EEA, where mandatorily applicable; however, we do not warrant full compliance with every local regulation. Users are responsible for ensuring that their use of the Service complies with the laws of their own jurisdiction.

11. Copyright Infringement Notices (DMCA / Japan Provider Liability Act)

If you believe that any content on the Service infringes your rights, please submit a notice through our inquiry form with the following information. We will follow applicable laws, such as the DMCA and Japan's Provider Liability Limitation Act, to take appropriate action, including temporary removal, notice to the poster, and acceptance of counter-notifications.

URL of the allegedly infringing content
Details of the right allegedly infringed and the grounds for your claim
A statement under penalty of perjury that your claim is accurate

We are not obligated to comply with takedown requests that do not follow the above procedure, and we are not liable for any damages arising from removal or disabling of content unless caused by our willful misconduct or gross negligence.

12. Terms Modification

We may modify these Terms as necessary. The modified Terms shall take effect upon being posted on the Service. Continued use of the Service after such modifications shall be deemed as acceptance of the modified Terms.

User Content

We do not endorse, guarantee, or assume responsibility for the content, accuracy, legality, or safety of any content posted by users (including all text, images, and links such as affiliate links). We are not liable for any issues arising from such content.

Third-Party Services

To maintain the integrity of the Service, the operator strives to develop features to detect and limit votes made by automated means or fraudulent methods ('Fraudulent Voting'). However, these features will be implemented gradually, and we do not currently guarantee the complete prevention or elimination of all Fraudulent Voting. The operator assumes no responsibility for the accuracy, reliability, or fairness of the voting results.

International Compliance

While the Service is available globally, it is primarily governed by the laws of Japan. We will make reasonable efforts to comply with additional legal requirements of other jurisdictions, including the EU/EEA, where mandatorily applicable; however, we do not warrant full compliance with every local regulation. Users are responsible for ensuring that their use of the Service complies with the laws of their own jurisdiction.

13. Governing Law and Jurisdiction

These Terms are governed by Japanese law, and disputes relating to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

14. Language

These Terms are prepared in Japanese, and translations into other languages are for reference purposes only. In the event of any conflict between the Japanese version and any translated version, the Japanese version shall prevail.

15. Paid Services and Premium Membership

The Service may offer premium membership and other paid services in the future. These features are planned for future release, but their contents and release timing are not guaranteed and are subject to change at our discretion.

15.1 Premium Features

Paid services are expected to include the following features:

Increased arena creation limits
Access to detailed voting analytics (voting patterns, statistical data, trend analysis, etc.)
Commercial use license (corporate/organizational use, commercial ranking utilization, etc.)
Ad-free experience
Priority support
Other additional features as determined by us

15.2 Commercial Use License

Users who obtain a commercial use license are permitted to engage in the following activities:

Corporate/organizational use of the Service
Commercial utilization of ranking results
Use for marketing and market research purposes
Posting affiliate links with appropriate disclosure
Other commercial activities as separately defined by us

The Commercial Use License grants the right to use the Service for business activities, but it must be used at the user's own discretion and responsibility, with the understanding that the Service is an entertainment tool. The operator assumes no responsibility for any consequences arising from the use of the Service. Spam activities, fraudulent advertising, and commercial activities that violate laws remain prohibited.

15.3 Subscription

Paid service fees are charged monthly or annually depending on the selected plan. Subscriptions are automatically renewed and will continue to be charged until cancelled.

15.4 Payment Processing

Payment processing is conducted through Stripe Inc. Credit card information is securely managed by Stripe, and we do not have direct access to it. Stripe's Terms of Service and Privacy Policy apply.

15.5 Cancellation and Refunds

Subscriptions can be cancelled at any time, but we generally do not provide refunds for charges already incurred, except where required by law or in special circumstances. After cancellation, the service remains accessible until the end of the current billing period.

16. Advertising and Monetization

The Service may utilize the following monetization methods in the future:

16.1 Google AdSense Advertising

The Service may display relevant advertisements using Google AdSense. Advertisement content is not directly managed by us and follows Google AdSense policies.

16.2 Operator Affiliate Programs

The Service may include links from affiliate programs in which we participate. When products or services are purchased through these links, we may receive referral commissions. Affiliate links are appropriately disclosed and do not incur additional costs for users.

16.3 User Affiliate Link Feature

In the future, we may provide arena creators who meet certain conditions set by us (such as monthly subscription users) with the ability to post affiliate links within their arenas. The terms of use for this feature, the scope of permitted products and services, prohibited activities, etc., will be separately announced when the feature is provided. When users post affiliate links, we will require them to implement appropriate display measures so that users can clearly understand that the links are affiliate links.

16.4 Advertising Disclosure

Advertisements and affiliate links displayed on the Service (including user-posted content) are appropriately disclosed in accordance with applicable laws. We take care to help users distinguish between advertising and service content.
